General Terms and Conditions of SIGN of MINE GmbH

within the framework of contracts concluded via the website www.sign-of-mine.de between SIGN of MINE GmbH, Neuturmstraße 10, 80331 Munich (hereinafter referred to as the “Provider”) and the customer named in Section 2 of this contract (hereinafter referred to as the “Customer”).

§ 1 Scope, definitions

(1) The following General Terms and Conditions, in the version valid at the time of the order, shall apply exclusively to the business relationship between the Provider and the Customer. Deviating terms and conditions of the Customer shall not be recognized unless the Provider expressly agrees to their validity.

(2) A consumer within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor independent professional. An entrepreneur is any natural or legal person, or a partnership with legal capacity, who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

§ 2 Conclusion of contract, confirmations and mandatory information

(1) The provider offers embroidered labels and accessories via the website www.sign-of-mine.de.

(2) The customer can select products and collect them by clicking the "Add to cart" button. By clicking the "Buy now" button, the customer submits a binding purchase request. The customer can view and change the details at any time before submitting the order.

(3) The provider checks the order and accepts it by sending an e-mail confirmation, which also contains the contract text.

(4) After receipt of payment, the dispatch of the ordered goods will also be confirmed by email.

§ 3 Delivery, availability of goods

(1) If the customer orders an item of the type described, the provider will deliver a corresponding item.

(2) If the product is permanently unavailable, the provider will inform the customer and refuse to accept the order. In this case, a contract will not be concluded.

(3) If the product is only temporarily unavailable, this will also be communicated in the order confirmation. The customer may withdraw from the contract in the event of a delivery delay.

(4) Shipping will take place after receipt of payment and completion of production.

(5) Non-personalized goods are generally ready for dispatch within 3 to 5 business days, personalized products within 8 to 10 business days. Delivery times may be extended before holidays. The provider has no influence on postal delivery times.

§ 4 Retention of title

(1) The goods remain the property of the provider until full payment has been made.

(2) The following also applies to businesses: The goods remain the property of the provider until all claims have been settled. In the event of a breach of contract, e.g., late payment, the provider may take back the goods. This also applies in the event of seizure of the goods. The customer shall bear the transport costs.

(3) The customer undertakes to treat the goods with care and to insure them adequately.

(4) In the event of seizure or access by third parties, the customer must immediately inform the provider in writing.

(5) At the customer’s request, the provider shall release securities if their realisable value exceeds the outstanding claims by more than 10%.

§ 5 Prices and shipping costs

(1) The prices valid at the time of the order apply. All prices are final prices including statutory VAT. Shipping costs within Germany are €4. Shipping is free for orders over €49. For other countries, the flat rate shipping fee is €12.

(2) The customer is responsible for proper customs clearance for deliveries subject to customs duties.

(3) Shipping costs are shown in the order form and are to be borne by the customer.

(4) Delivery shall be made by mail. The shipping risk shall be borne by the provider if the customer is a consumer.

§ 6 Payment options

(1) Accepted payment methods are credit card, invoice, and PayPal. The provider may exclude certain payment methods. The customer accepts receiving invoices and credit notes electronically.

(2) The purchase price is due upon conclusion of the contract. Payment via PayPal will be charged immediately.

(3) In the case of credit card payments, the debit will be made upon dispatch.

(5) Interest on late payment and further damages remain reserved.

(6) Delivery is made via the provider’s logistics partners.

§ 7 Warranty for material defects, guarantee

(1) The provider is liable for material defects in accordance with statutory provisions. For businesses, the warranty period is 12 months, excluding claims for damages pursuant to Section 8.

(2) A guarantee only exists if it is expressly stated on the product.

§ 8 Liability

(1) The provider shall not be liable for simple negligence, except in cases of injury to life, body, health or material contractual obligations.

(2) In the event of a breach of essential contractual obligations, the provider shall only be liable for damages typical for the contract and foreseeable.

(3) The limitations of liability also apply to legal representatives and vicarious agents.

(4) The provisions of the Product Liability Act remain unaffected.

§ 9 Right of withdrawal for distance contracts

(1) For distance selling contracts with consumers, the right of withdrawal shall apply in accordance with Section 10.

(2) Distance contracts are contracts concluded exclusively by means of distance communication.

§ 10 Cancellation policy for goods

(1) You have the right to withdraw from the contract within fourteen days without giving any reason. This period begins on the day on which you or a third party designated by you receive the goods. To exercise this right, a clear declaration (e.g., email to info@sign-of-mine.de) is sufficient.

(2) In the event of cancellation, we will refund all payments, including delivery costs, within fourteen days. The refund will be made using the same means of payment. We may refuse to refund until we have received the goods back or provided proof of return shipment. The return must be made within fourteen days. We will bear the return shipping costs.

(3) There is no right of withdrawal for personalized products or products clearly tailored to personal needs, or for discounted goods.

§ 11 Copyrights to designs, indemnity

Texts or content that are racist, sexist, politically extreme, or discriminatory may be rejected by the provider. SIGN of MINE GmbH assumes no liability for printing errors, translation errors, or technical errors on the website.

§ 12 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction is Munich if the customer is a merchant or a legal entity under public law.

(3) Should individual provisions be invalid, the remainder of the contract shall remain valid. Invalid clauses shall be replaced by the statutory provisions.
